I. GENERAL CONDITIONS

1. This Privacy Policy (hereinafter – “the Policy”) applies to relations between SIA “BAUSKAS ALUS” (hereinafter – “the company”), registration number 50003428811, registered address: Bērzkalnu iela 77, Bauska, Bauskas nov., LV-3901, and natural persons who purchase products, provide services or otherwise communicate with the company (hereinafter – “you”), among other things, using the company website or contacting the company on social networks.
2. The company processes your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Personal Data Processing Law of the Republic of Latvia.
3. The company ensures protection of personal data in accordance with requirements of the effective laws and implementation of appropriate technical and organisational measures for protection of personal data against unauthorised access, disclosure, accidental loss, modification or destruction, or any other illegal processing.

III. LEGAL BASIS AND PURPOSES OF PROCESSING YOUR PERSONAL DATA

5. The company processes personal data (name, surname, phone number or e-mail and other personal data provided to the company), provided by natural persons who have submitted their application, complaint, request or have otherwise contacted the company in writing (including through e-mail or using postal services, on social networks and in procedural documents), incl. the company's reply concerning the basis of consent or legitimate interests (depending on the request, complaint or other application received, and other circumstances), for examination of this request or complaint, investigation and replying to the request or complaint.
6. The company processes personal data of those natural persons who call the company's call centre number 63960013 (phone number and other data provided during the call), based on own legitimate interests, purposes, request examination and responding, and ensuring of the service quality.  
7. The company processes personal data of candidates for vacancies announced by the company (name, surname, CV and other data provided to the company by the person), based on the company's legitimate interests (selection for vacancies), for selection of candidate for a specific position in order to determine suitability of the candidate for the position. If the company obtains information about the candidate and/or the candidate's data from the provider of job searching services, career social networks and/or websites of other job searching, selection and/or mediation service providers, the company considers that the candidate is already notified of processing of his/her personal data and has consented to such processing of personal data by the company (or his/her data is processed on another legal basis), which also includes the right to provide own personal data to potential employers (including the company) for processing of personal data of candidates during the staff selection process. The company may view profiles of candidates on career social networks (for example, LinkedIn) and the information posted in these profiles, based on the company's legitimate interests, in order to assess, whether the information provided by the candidate to the company corresponds to the publicly available information in the candidate's profiles on professional social networks. If the candidate and the company conclude a contract, the data obtained during the selection procedure are transferred to the employee's file. If the candidate and the company do not conclude an employment contract, at the end of the selection process, the company processes the data related to the candidate only in cases, when the candidate gives explicit consent to the company for processing of his/her personal data after conclusion of the selection process, and such data shall be processed on a legal basis of given consent with a purpose to invite the candidate for participation in future staff selection processes organised by the company.
8. The company does not process special categories of personal data related to you, which reveal your race or ethnic origin, political views, religious or philosophical beliefs, membership in trade unions, health data or data about sexual life or sexual orientation.
9. The company processes the personal data of natural persons who have applied for the company’s shop customer loyalty card (hereinafter – “Loyalty Card”) by filling in an application form at the company’s shop. 
9.1. Information about the company’s shops where Loyalty Cards can be obtained:
a) SIA “BAUSKAS ALUS” shop at Biķernieku iela 143, Vidzemes priekšpilsēta, Rīga, LV-1021;
b) SIA “BAUSKAS ALUS” shop at Mūkusalas iela 73, Zemgales priekšpilsēta, Rīga, LV-1004;
c) SIA “BAUSKAS ALUS” shop at Āgenskalna Tirgus, Nometņu iela 64, Zemgales priekšpilsēta, Rīga, LV-1002;
d) SIA “BAUSKAS ALUS” shop “Bauskas miestiņš un citi labumi” at Pionieru iela 1K-1, Bauska, Bauskas novads, LV-3901;
9.2. The company processes your data on the basis of your consent in order for the company to issue you with the company’s shop Loyalty Card and to provide you with the benefits associated with the Loyalty Card, which you may receive if you have filled in the application form and received the company’s shop Loyalty Card. 
9.3. The company processes the following data provided by you: 
9.3.1. name, surname – it is mandatory to provide this data; based on the data you provide in the form, we recognise you as the owner of the Loyalty Card, for example, if you want to use the Loyalty Card in the company’s shops to receive benefits or other offers, as well as in cases when you need to update or change your data, contact us regarding the submission of relevant personal information, to exercise rights related to the processing of personal data and in other cases. A company employee has the right to ask to see an identity document to confirm your identity and to verify that the potential Loyalty Programme participant is an adult (at least 18 years of age).
9.3.2. e-mail address or phone number (or both types of communication). This data can be provided alternatively, i.e. at least one type of communication must be indicated in the form. We use the contact details you provide in the application form to cooperate with you, for example by responding to your letters and other enquiries. Your e-mail address or mobile phone number is required to contact you in urgent cases where this is necessary (e.g. if a company’s shop loyalty card is found or lost, etc.). Your phone number or e-mail is used to provide you with the information you need about using the Loyalty Card, for example, about any changes to the Loyalty Card Terms and Conditions, benefits, the Policy, etc. This also applies to cases when you have consented to commercial communications being sent to you. 
9.4. In order to protect its legitimate interests, the company may process your personal data to defend, establish and enforce legal claims, including to prevent and/or stop fraudulent or criminal activity, to gather evidence of identified problems and manage the situation, and to stop unlawful or abusive use of our products or services.
9.5. It is your responsibility to provide only truthful data that is valid and necessary for the purposes set out in this text. By filling in the application form for a Loyalty Card, you acknowledge that the personal data you have provided is accurate and correct. If the personal data is inaccurate, you must correct it immediately. If you provide incorrect or inaccurate data, forget or fail to update your data as it changes, we may have difficulties in providing you with the benefits of the Loyalty Card or in exercising your rights. In certain cases, we may be forced to block your Loyalty Card and terminate your participation in the use of the company’s shop Loyalty Card, for example, if we need to obtain or update your consents to use the Loyalty Card but we are unable to identify you as the holder of that Loyalty Card.


IV. PERIOD OF PROCESSING OF YOUR PERSONAL DATA

9. The company processes your data as long as necessary for the purpose this data was obtained and is used for. The company sets a period of processing of personal data in accordance with the nature of the concluded contracts, statutory requirements and/or the company's legitimate interests:
9.1. Personal data of natural persons calling the call centre number 63960013 (phone number and other data provided during the conversation) may be processed by the company on a basis of its legitimate interests, purposes, for examination of requests and ensuring of the service quality. 
9.2. The company processes personal data of candidates for vacancies (name, surname, phone number and e-mail address, CV data and related data), received directly from candidates, as well as from online job search portals, career social media accounts and/or other persons who provide job search services, candidate selection and/or mediation services until the end of the respective selection process. If the candidate gives explicit consent to the company for further processing of their personal data at the end of the selection procedure for the company to be able to invite the candidate for participation in future employee selection procedures of the company, the company shall process such data for a period of 6 months from the date of such consent.
9.3. Your data collected when you apply for the company’s shop loyalty card by filling in the company’s shop loyalty card form is stored for as long as you have and use the company’s shop loyalty card. If, within 3 (three) years from your last purchase or from the date of issue of the card, you do not use the company’s shop loyalty card, i.e. by making purchases in the company’s shop or in any way using the benefits associated with the company’s shop loyalty card, all data provided by you and received by the company in connection with the loyalty card will be deleted, as well as in cases where you have withdrawn your consent to the processing of your data. This consent cannot be withdrawn for the period during which you have consented to the processing of your data in order for the company to prepare and issue you the company’s shop loyalty card.
10. In other cases the company shall set a term for processing of personal data, taking into consideration the purpose of processing of personal data, statutory requirements and/or company's legitimate interests, including, but not limited to, the interest in processing and storing of personal data for the purpose of potential raising of another claim.
11. Storage of your personal data for a period exceeding the term specified in the notice may take place only if:
11.1. There are reasonable grounds for suspecting illegal action, which is under investigation,
11.2. Your data is required for correct examination or resolution of dispute or complaint,
11.3. It is necessary on a statutory basis, on other conditions or in cases stipulated in other laws.


V. SOURCES OF YOUR PERSONAL DATA

12. The company may obtain personal data directly from you (for example, while making phone calls to the company, and otherwise).
13. In separate cases the company may obtain personal data from the company's customers (natural persons and legal entities), who provide services to the company, for example, from persons providing employee selection services.
14. In separate cases the company may obtain your personal data from other data controllers, state institutions and bodies (for example, law enforcement institutions, bailiffs, etc.), as well as judicial and extrajudicial dispute resolution institutions.
15. The list of sources of personal data mentioned in this section is not exhaustive.


VI. TRANSFER AND PROCESSING OF YOUR DATA

16. In separate cases statutory requirements allow imposing an obligation on the company to disclose (transfer) personal data to third parties, for example:
16.1. state institutions and bodies that perform functions granted to them under laws (for example, law enforcement institutions, bailiffs, etc.), as well as judicial and extrajudicial disputes resolution institutions,
16.2. as well as in other cases not stated in this notice in accordance with statutory requirements.
17. The company may attract data processors for processing of personal data. In these cases the company implements the necessary measures to ensure that processing of personal data carried out by such data processors meets confidentiality requirements, the company's instructions and provisions of applicable laws, implementing appropriate technical and organisational measures for protection of personal data.


VII. GEOGRAPHICAL PROCESSING

18. In general, the company processes personal data in the territory of the European Union (EU) and the European Economic Area (EEA).


VIII. YOUR RIGHTS

19. You have the following rights:
19.1. The right to know (be informed) about processing of personal data related to you;
19.2. To request the company to ensure access to the processed personal data concerning you. Please note that the access rights may be restricted by laws and restrictions for exercising of rights granted under these laws, as well as protection of privacy and personal data of other persons, and other reasons. The access rights may not be applicable to information that constitutes the company's commercial secret and/or confidential information, the company’s internal and other related materials and documents;
19.3. The right to request the company to rectify any false, inaccurate or incomplete personal data concerning you;
19.4. The right to restrict processing of your personal data until the moment, when the company has verified lawfulness of processing of your personal data at your request;
19.5. The right to request the company to delete your personal data that is processed on a legal basis of your consent, if such consent is revoked. This right is not applicable, if personal data is processed on another legal basis, for example, for performance of contract and/or fulfilment of statutory requirements;
19.6. The right to request the company to transfer your personal data to another data controller or provide this data directly to you in a structured, widely used and machine-readable format (applies to personal data provided by you, which is processed based on your consent or a contract concluded with you). The right to transfer your data may be not applicable to the company's commercial secret, internal and other related materials and documents. After exercising the right of transferring your personal data, the company does not delete the data in its possession automatically. If you want the company to delete your data, you shall notify the company in order to exercise your right of deleting your personal data;
19.7. The right to revoke your consent, which will not affect processing of your personal data carried out until the moment of revocation of consent;
19.8. The right to object to processing of your personal data, based on your legitimate interests, unless there are legitimate bases for such processing or setting, implementation and defence of legal requirements;
19.9. The right to file a complaint to the Data State Inspectorate, if you hold a view that processing of your personal data infringes your rights of protection of personal data (see more detailed information on the website https://www.dvi.gov.lv/lv, or contact the Inspectorate, address: Elijas iela 17, Rīga, LV-1050, via e-mail pasts@dvi.gov.lv). Prior to filing a complaint to the supervisory authority, we advise to contact the company, using the contact information indicated in section II of this notice, in order to resolve your problem properly.


IX. EXERCISING OF YOUR RIGHTS

20. Your request for exercising the rights stated above, as well as any complaint, notice, request or other letter related to protection or processing of personal data (hereinafter – “the request”) can be submitted as follows:
20.1. By submitting a written application to the company located at the address Bērzkalnu iela 77, Bauska, Bauskas nov., LV-3901. Please note that the company employee will ask you to present an identity document for verification of your identity;
20.2. By sending an application signed with your electronic signature to the e-mail address bauskasalus@bauskasalus.lv.  
21. The company is entitled to refuse provision of the requested information, if the request is groundless or excessive.
22. The company will reply to your request within 1 month from the date of receipt of request corresponding to the effective requirements. In exceptional cases, after notifying you and explaining the circumstances, the company may extend this period for another 2 months.
